1. Agreement
By accessing or using https://vivalty.com (“the Platform”) operated by Vivalty, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.
2. What Vivalty provides
Vivalty is a property marketplace and information service. We display listings, investment scores, yield estimates, simulators and an AI research assistant to help you research international property opportunities.
Vivalty is not a regulated investment advisor, broker, estate agent, bank or tax adviser. Nothing on the Platform constitutes personalised financial, legal or tax advice, an offer to sell securities, or a recommendation to buy or sell any property.
3. No guarantees
Scores, yields, ROI figures, cash-flow projections and AI-generated text are indicative research tools based on available data and documented assumptions. Past performance and modelled outcomes are not guarantees of future results. Always verify title deeds, rental contracts, tax treatment and regulatory requirements with qualified professionals and listing agencies before committing capital.
4. Accounts
You must provide accurate registration information, keep credentials secure and be at least 18 years old. We may suspend accounts that violate these Terms or applicable law.
5. Listings & third-party content
Many listings are supplied by third-party agencies. Vivalty does not guarantee accuracy, availability or legality of any listing. Transactions occur between you and the relevant agency or seller; Vivalty is not a party to property sales or leases unless explicitly stated.
6. Acceptable use
You agree not to:
- Misuse the Platform, scrape data at scale, or attempt unauthorised access.
- Submit false enquiries, spam or misleading listing content.
- Rely on Platform outputs as sole basis for investment decisions without independent due diligence.
- Use the AI advisor to obtain regulated financial advice or to make binding decisions on our behalf.
7. Intellectual property
Vivalty branding, scoring methodology, software and curated content are protected. You may not copy, resell or reverse-engineer the Platform except as permitted by law.
8. Limitation of liability
To the fullest extent permitted by law, Vivalty is not liable for indirect, consequential or investment losses arising from use of the Platform, reliance on scores or projections, or actions of third-party listing partners. Our total liability for any claim is limited to the greater of £100 or fees you paid us in the 12 months before the claim.
9. Changes & termination
We may modify the Platform or these Terms. Continued use after changes constitutes acceptance. We may discontinue features or terminate access for breach.
10. Governing law
These Terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction, without prejudice to mandatory consumer rights in your country of residence.
